答:生产者对其产品质量的责任和义务:

(1)不存在危及人身、财产安全的不合理的危险,不违反国家有关强制性标准的规定。产品安全是法律对产品最基本的要求,也是衡量产品质量的最起码的限度。

(2)产品应具有应当具备的使用性能。产品的使用性能是产品的价值所在,也是产品被购买者或使用者接受的原因。不具备相应的使用性能的产品被消费者购买,就会形成对消费者的欺诈或损害,构成生产者的责任。

(3)产品应当符合在其表面或包装上注明采用的产品标准,符合以产品说明、实物样品等方式表明的质量情况。对产品性能或采用标准的任何陈述都构成生产者对产品的购买者或使用做出的产品质量担保, 不论这种陈述采用的是什么形式。即使产品本身质量合格,但不符合生产者所做出的有关产品质量的陈述,生产者也要承担法律责任。
